We are committed to respecting your privacy. We collect a single email address for each account when you use our Services. This email address is automatically extracted when you log in using your Google or Microsoft accounts. This is done solely for authentication purposes and to store your conversation history within our Services.
Optionally, users may choose to set up the OpenAI API key in their account settings. This key is used exclusively to facilitate your chatbot’s conversations with OpenAI and is not shared with any third parties.
Users can optionally upload documents to our Services. These documents are stored in the Pinecone Vector database, which is a third-party cloud SaaS-based platform. We delete the documents as soon as they are processed by Pinecone. Please note that Pinecone has its own privacy policy, which we recommend you review.
2. Conversation Data Collection
Our Services collect and store your conversation history. This encompasses all the interactions you have with our chatbot. This conversation history, along with the optional OpenAI API key, is passed to the OpenAI platform via their API for the purpose of facilitating the chatbot conversations. Please note that OpenAI has its own privacy policy, which we recommend you review. We do not actively use or analyse this conversation data for any other purposes.
3. Payment Information Collection
For our paid services, we collect payment information. Users provide their credit card information for monthly subscriptions. We rely on third-party services, namely Stripe, for payment processing. We do not directly store any credit card information.
4. Use of Cookies
Our Services use cookies to provide optimal functionality. Specifically, we use session cookies, which are temporary cookies that remain in the cookie file of your browser until you leave the site. These cookies are essential for certain features of our Services. They help remember your login details and customize your user experience. These cookies do not collect information from the user’s computer, and they do not contain personal information. Please note that these cookies are necessary for you to navigate our Services, and cannot be opted out of while using our Services.
5. Data Disclosure
FifthElement and Thales Labs do not directly share your personal data with third parties. The exception to this is the personal data that may be included within your chat conversation history. When using our Services, any information you provide during chatbot interactions is passed to OpenAI via their APIs for the purpose of facilitating the chatbot conversations. We do not control or manage this data once it has been passed to OpenAI. Please note that OpenAI has its own privacy policy regarding their handling and use of this data, which we recommend you review.
6. Data Security
The security of your personal data is of utmost importance to us. The personal data we collect from you is stored in the cloud for our SaaS offering. For our enterprise customers, the data may be stored either in a private cloud or on their premises based on their requirements. We implement a variety of security measures to maintain the safety of your personal information. However, please note that no method of transmission over the internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal data, we cannot guarantee its absolute security. In the event of a data breach, we will take all necessary steps required by law and make every effort to inform any users who may be impacted as soon as possible while also working diligently to rectify the breach.
7. Children’s Privacy
Our Services do not address anyone under the age of 13. We do not knowingly collect personal identifiable information from children under 13.
8. User Rights
You have the right to access the email address associated with your account. If you wish to request deletion of your personal data, please send an email to support@fifthelement.ai. Upon receipt of such a request, we will ensure all your personal information is deleted from our records.
9. International Data Transfers
For users within the United States, we do not transfer your personal data across international borders. All data collected and processed through our Services for US users remains within the United States. However, due to the nature of our SaaS offering, personal data of users outside the United States may be transferred across international borders. We ensure that appropriate safeguards are in place to protect your data during these transfers, such as using secure data transfer protocols and adhering to applicable data protection laws and regulations.
10. Use of Google Tag Manager
We use Google Tag Manager (GTM) that helps us manage and deploy the tracking technologies on our website more efficiently. GTM itself does not process personal data but helps to integrate other services, which may process your data. GTM works in conjunction with cookies to help us understand how users interact with our services. The tool enables us to measure user traffic and behavior, track the impact of online advertising, and optimize our services. It also helps us with deploying and managing the third-party tags that may be used on our website. Please note that while GTM triggers other tags, it does not access the data collected by these tags. If you choose to delete your account or request the deletion of your personal data, your conversation history will be deleted along with your account information.

Please note that third-party platforms, such as OpenAI and Stripe, have their own data retention policies. We do not have control over these policies, and we recommend that you review their respective privacy policies for more information.
